It is the owner of the electronic network for services (NESBAH).
It is 100% Saudi.
Its headquarters is in Makkah Al-Mukarramah.
This agreement refers to "Nesbah," "we," "us," or "the network," and represents the first party.
2. Details of the Agreement's Terms
1. The User (Second Party)
is the user of the electronic account, whether an individual, institution, company, or agent, who accesses the website and benefits from its services by registering and adding the product representing the second party.
2. Electronic Marketing Platforms
Means platforms licensed under the laws of the Kingdom of Saudi Arabia.
3. Agreement
Means the user agreement for the product service on these electronic marketing platforms.
Which includes the terms and conditions governing the use of the service.
4. Service
Means the service provided by the Nisbah website via the internet.
It aims to enable the user to display the product registered with the electronic marketing platform.
3. Terms of Use
As the (Second Party) to this agreement and wishing to benefit from this service, you must abide by the following:
1. Nisbah is not responsible or liable for any technical, financial, or regulatory matters between users.
Its mission is limited to communicating information about the product registered with it by another user,
for the purpose of marketing it and collecting the due percentages.
2. The percentage provides options for obtaining a percentage of the sale or brokerage in the ad placement options (if available), and is not required to calculate what is not requested.
3. The percentage provides a way to display the product without a means of communication - responses - underpricing the product.
It hides the user's private data so that it does not appear to other users and cause them distress.
It instead delivers a notification of the price offer, and you have the freedom to accept or reject the request.
4. The value of the advertising percentage is displayed in the description to make it easier for the buyer to know what to pay.
5. If the offer is received and accepted, the buyer will be transferred to the electronic payment page. The buyer will see a full statement of the percentage to be paid and to whom (website, advertiser, broker).
6. After completing the payment process, the ad will be transferred from the advertiser's page to the buyer's data page in the "My Purchases" icon. Users (seller and buyer) will receive notifications with the other party's data to communicate and deliver the product.
7. If you do not reach an agreement after the inspection, return to the site and fill out the questionnaire within 48 hours, and choose a refund method.
8. The rate provides one free ad for one day, but it does not include some of the features you'll find in the packages through which you can:
1. Increase the number of ads
2. Increase the number of days
3. Activate (advertiser rate - e-wallet - rental contracts)
4. Permissions that allow you to benefit from the existing sections
(funded - auction - real estate - guaranteed - commercial)
5. A rate is provided for users to benefit from an e-wallet.
10. Rental contract rates are available and can only be requested for the first year.
11. The advertiser will be given the freedom to negotiate the price of their product or not. Furthermore, the price of the product will be reduced in the event of negotiation, starting at 50% of the highest price.
12. In the event of a negotiation, Nisbah provides the lowest negotiated price, so that the negotiator cannot lower the highest price reached.
5. The User
1. Is primarily and ultimately responsible for the accuracy and validity of the product and contact information, as well as all related information in his/her registered data.
2. Is responsible for the accuracy of the attached product images, ensuring they comply with applicable laws and regulations, and ensuring they do not violate Sharia regulations, customs, and traditions in the Kingdom of Saudi Arabia.
3. Nisbah is not responsible for the content of the offer suspended by the user or any resulting legal consequences. The user bears full responsibility in this regard. In the event of a violation, Nisbah will take the legal action assigned to it, by concealing the advertisement from everyone, including the advertiser, and referring the advertiser to legal affairs for necessary action.
4. The user undertakes not to hack or analyze the network's laws, policies, and regulations, or any rights related to a third party.
5. The user undertakes not to tamper with product prices or data or harm other users.
6. The user acknowledges that all information he/she has disclosed is true, accurate, complete, up-to-date, represents him/her, is his/her own property, or that he/she has authorized (the owner/broker), and complies with what is required in the registration form at Nisbah.
7. The user undertakes not to publish false, inaccurate, misleading, deceptive, defamatory, or libelous advertisements or comments, or to include prohibited advertisements.
8. The user undertakes not to engage in political or religious affairs, undermine the sovereignty of the state or other countries, attack prominent figures, or engage in any discussions unrelated to the products offered.
9. The user undertakes not to violate copyrights, trademarks, patents, advertising rights, or databases.
10. The user undertakes not to do anything that would harm Nisbah's reputation.
1.1. The user undertakes not to impersonate Nisbah or any of its representatives, employees, or any position that suggests they are affiliated with Nisbah unless they have official permission or an identification card from Nisbah.
1.2. The user undertakes that the images added to the product data match the advertised product.
1.3. The user undertakes to verify the identities and personalities of the product owners for the purpose of registering or advertising it.
1.4. The user acknowledges that they will be constantly informed of the terms and conditions.
Wallet
1. The amounts added to the wallet are allocated for website payment transactions
(purchasing packages - paying the site's percentage - bidding - commercial advertisements - guaranteed - rent)
Terms and Conditions for Real Estate Advertisers:
I pledge that all the terms and requirements listed below are met by me and I bear responsibility for them, and the website bears no responsibility.
Publishing a real estate ad is limited to the advertiser being:
1. A natural person of Saudi nationality.
2. A legal entity licensed to practice activity in the Kingdom.
3. Non-Saudi advertisers of properties owned by them who have previously registered as advertisers through the National Access Platform.
4. As an advertiser, I must fall into one of the following categories:
A. The owner
B. Authorized by the owner by written authorization or by court order
5. I will remove the real estate ad, and it must not be misleading, fictitious, infringing on intellectual property rights, or violating the provisions of the regulations and standards.
6. If I use the map platform,
1. I will accurately locate the property upon the advertiser's request.
2. Not revealing the exact location to the public.
3. Technically linking with the Authority and providing it with the required data.
Maintaining the confidentiality of information, protecting and assuming full responsibility for user data and privacy and the intellectual property rights of third parties (specific to the site).
4. Adhering to the requirements issued by the relevant authorities regarding data and cybersecurity.
5. Publishing the privacy policy, intellectual property rights policy, and the terms and conditions of use of the platform.
7. The user must be aware of the following points:
Regarding (lease) contracts:
· The lease term will be one year. If the user wishes to extend the term, this can be done by contacting the administration via the communication platforms attached to the homepage.
· The lease value will be calculated as 2.5% of the contract value for the first year.
· The user will pay the state fees through the platforms provided by the Ejar platform.
For residential rent, SAR 125, including VAT.
For commercial rent, SAR 200, including VAT.
The user must complete the information form in the contracts section, and it must be accurate.
The user who completes the contracts form bears full responsibility toward the legal authorities of the country if it is found that their information is incorrect.
